Women In Honduras

Honduran law requires perpetrators of domestic violence acts to do community service and serve in preventative detention for 24 hours only if the perpetrator is caught in the act. The law provides a maximum sentence of three years’ imprisonment for disobeying a restraining order connected with the crime of intra family violence.

The penalties for rape range from 3 to 9 years imprisonment. Spousal rape is considered on a case by case basis. All other rapes are considered public crimes and a rapist can be prosecuted even if the victim does not want to press charges.

Opportunities for women to participate in politics, particularly for those seeking elected office, remain limited, although in 2005 32 women were elected as members of the 128-seat National Congress, the largest number of women ever elected to the legislature. Also in 2005, there were 9 female justices, including the president, on the 17-member Supreme Court. A gender equality law was passed in 2000, which requires all political parties to confer women at least 30 percent of posts.

The majority of women work in lower status and lower paid jobs in the informal economic sector, such as domestic service. These positions lack legal protections or regulation. Cultural attitudes impede women’s’ career opportunities. The law requires employers to pay women equal wages for equivalent work, but employers often classify women’s jobs as less demanding than those of men to justify paying them lower salaries.
